Nirmala Sapre Case: Supreme Court Gives MP Speaker 2 Months to Decide MLA’s Fate

The Supreme Court of India has directed the Madhya Pradesh Legislative Assembly Speaker to decide within two months on a pending disqualification petition against Bina MLA Nirmala Sapre. The direction comes in a case that has remained unresolved for more than two years and raises important questions about the implementation of India's anti-defection law.

A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V. Mohana emphasised that petitions filed under the Tenth Schedule of the Constitution must be decided without unnecessary delays.

The court's direction places a specific timeline on the Madhya Pradesh Assembly Speaker to conclude the proceedings concerning the allegations against Sapre.

Why Is Nirmala Sapre Facing a Disqualification Petition?

Nirmala Sapre was elected as a Member of the Legislative Assembly from the Bina constituency in Madhya Pradesh's Sagar district during the 2023 Assembly elections on a Congress ticket.

The disqualification petition was filed by Madhya Pradesh Leader of Opposition Umang Singhar in July 2024. It alleges that Sapre voluntarily gave up her membership of the Indian National Congress and subsequently aligned herself with the Bharatiya Janata Party (BJP).

The allegations relate to her appearance at a BJP political programme during the 2024 Lok Sabha election campaign, reportedly in the presence of Madhya Pradesh Chief Minister Mohan Yadav.

However, Sapre has denied leaving the Congress or formally joining the BJP. The allegations remain subject to adjudication by the Assembly Speaker.

Supreme Court Questions Delay in Anti-Defection Proceedings

During the hearing, the Supreme Court expressed concern over the prolonged pendency of the disqualification petition.

The bench observed that matters arising under the Tenth Schedule should be addressed expeditiously, even when there is no immediate urgency or considerable time remains before the completion of an Assembly's tenure.

The Supreme Court also disagreed with the Madhya Pradesh High Court's earlier approach, which had declined to direct the Speaker to decide the matter within a fixed timeframe.

The petitioner, represented by senior advocate Vivek Tankha, argued that the allegations involved a significant question concerning the constitutional framework governing political defections.

Following the submissions, the Supreme Court directed the Madhya Pradesh Assembly Speaker to deliver a decision within two months.

What Does the Tenth Schedule Say About Political Defection?

The Tenth Schedule of the Indian Constitution, commonly known as the Anti-Defection Law, was introduced through the 52nd Constitutional Amendment Act, 1985.

It provides provisions for disqualifying elected representatives under specified circumstances, including voluntarily giving up membership of their political party or voting against party directions in certain situations.

The law aims to address political defections and maintain stability in the legislative system.

The Supreme Court has previously emphasised the importance of timely decisions in disqualification proceedings, including in cases involving legislative speakers in other states.

What Happens Next in the Nirmala Sapre Case?

With the Supreme Court setting a two-month deadline, the Madhya Pradesh Assembly Speaker must now decide the pending disqualification petition within the prescribed period.

The final decision will determine whether the allegations meet the constitutional grounds for disqualification under the Tenth Schedule.

Importantly, the Supreme Court has not declared Nirmala Sapre disqualified. The merits of the allegations remain to be decided by the Assembly Speaker.

The development is significant for Madhya Pradesh politics as well as the broader constitutional debate surrounding the timely adjudication of anti-defection petitions in India.

The central question now is whether the pending proceedings will reach a final conclusion within the two-month deadline set by the country's highest court.
